Service Terms and Conditions 

1. Introduction 

These Service Terms and Conditions apply to services provided by Aspects Mediation Services Ltd (“the Provider”). 

Applicable to:

  • Workshops; 
  • Leadership Masterclasses;  
  • One-to-One Conflict Navigation Sessions; 
  • The Conflict Health Check report 

These Terms explain the basis on which services are provided and form part of the agreement between the Provider and the Client. 

2. Booking and Acceptance 

A booking is confirmed when the Client: 

  • accepts the proposal or agreed service arrangements by email; 
  • issues a purchase order;   or 
  • pays the invoice. 

Fees, payment terms and agreed service arrangements will be confirmed in writing before the booking is finalised and will be reflected in the accepted proposal, booking confirmation and/or invoice. 

By accepting the proposal by email, issuing a purchase order, or paying the invoice, the Client confirms the booking and acceptance of these Service Terms and Conditions. 

For organisational bookings, the person confirming the booking confirms that they have authority to accept these Terms on behalf of the organisation. 

3. Services Provided 

The Provider offers professional development and conflict navigation services designed to support individuals and organisations in developing awareness, skills and practical approaches for managing communication and conflict. 

Services may include: 

Workshops 

Educational sessions designed to introduce practical approaches to communication, conflict awareness and constructive conversations. 

Leadership Masterclasses 

Professional development sessions designed to support leaders and managers in developing confidence and skills for navigating workplace conversations and conflict. 

One-to-One Conflict Navigation/Conversation Navigation Sessions 

Individual sessions providing structured support, reflection and practical guidance for navigating challenging conversations or conflict situations. 

Conflict Health Check 

A structured review designed to help individuals or organisations better understand current conflict challenges, identify key themes and consider appropriate next steps. 

The Conflict Health Check is intended to provide insight and guidance on possible routes forward. It is not an investigation, formal assessment, legal opinion or guarantee of a particular outcome. 

4. Fees and Payment 

Fees, payment arrangements and any agreed delivery requirements will be confirmed before the service begins. 

Payment terms will be stated on the invoice. 

Where payment is not received within the agreed timeframe, the Provider reserves the right to postpone delivery until payment arrangements have been resolved. 

5. Client Responsibilities 

The Client agrees to: 

  • provide accurate information relevant to the service; 
  • communicate any relevant requirements in advance; 
  • ensure participants understand the purpose of the service; 
  • support respectful and constructive participation. 

For organisational bookings, the Client is responsible for ensuring appropriate communication with participants before the service. 

6. Confidentiality 

The Provider respects the confidentiality of information shared during sessions. 

Participants are expected to respect the confidentiality of personal experiences, workplace situations and discussions shared by others. 

Confidentiality may be limited where: 

  • disclosure is required by law; 
  • there are safeguarding concerns; 
  • there is a risk of serious harm to an individual or others; or 
  • disclosure is necessary to meet professional responsibilities. 

For One-to-One Conflict Navigation Sessions, confidentiality boundaries will be discussed at the beginning of the session. 

7. Safeguarding 

The Provider aims to create a safe and respectful environment. 

Where information shared indicates a safeguarding concern or a risk of serious harm, the Provider may need to take appropriate action, including seeking advice or making a referral where necessary. 

8. Professional Boundaries and Disclaimer 

Services are provided for educational, developmental and conflict support purposes. 

The Provider does not provide: 

  • legal advice or legal representation; 
  • counselling or psychotherapy; 
  • mental health treatment; 
  • medical advice; 
  • diagnosis of any condition; or 
  • a replacement for specialist professional support. 
  • Clients remain responsible for seeking appropriate advice or support where required. 

9. Outcomes 

The Provider aims to provide valuable learning, reflection and practical tools. 

However, outcomes depend on individual circumstances, participation and the willingness of those involved to apply learning. 

No guarantee is made regarding specific personal, professional, organisational or conflict-related outcomes. 

10. Learning Environment 

For workshops and Leadership Masterclasses, the Provider is committed to creating a respectful and constructive learning environment. 

Participants are expected to engage appropriately and respect the experiences shared by others. 

The Provider reserves the right to pause or end participation where behaviour is abusive, threatening, discriminatory or significantly disrupts the learning experience of others. 

11. Venue and Delivery Arrangements 

For in-house workshops and Leadership Masterclasses, the Client is responsible for providing a suitable learning environment unless otherwise agreed. 

The venue should provide appropriate space, seating and any agreed facilities required for effective delivery. 

Where the Provider is requested to arrange a venue on behalf of the Client, the venue cost will be recharged together with an administration fee of 15% of the venue hire cost. 

The Client is responsible for ensuring reasonable access to the venue for preparation and delivery. 

12. Participant Numbers 

Fees for organisational services are based on participant numbers agreed at booking. 

Any significant changes to participant numbers should be discussed in advance and may require a review of the agreed fee. 

13. Programme Content 

The Provider may make reasonable adjustments to content, materials or activities where this supports learning objectives, improves delivery or reflects changes in professional practice. 

14. Cancellation, Refunds and Rescheduling 

Cancellation or rescheduling requests must be made in writing. 

Leadership Masterclasses 

The following refund arrangements apply: 

  • Cancellation received 21 calendar days or more before delivery: 100% refund. 
  • Cancellation received 8–20 calendar days before delivery: 50% refund. 
  • Cancellation received 7 calendar days or fewer before delivery: no refund. 

Workshops 

The following refund arrangements apply: 

  • Cancellation received 14 calendar days or more before delivery: 100% refund. 
  • Cancellation received 7–13 calendar days before delivery: 50% refund. 
  • Cancellation received 6 calendar days or fewer before delivery: no refund. 

One-to-One Conflict Navigation Sessions 

The following refund arrangements apply: 

  • Cancellation received 7 calendar days or more before the session: 100% refund. 
  • Cancellation received 3–6 calendar days before the session: 50% refund. 
  • Cancellation received less than 3 calendar days before the session: no refund. 

Where possible, the Provider may offer an alternative appointment date instead of a refund, subject to availability. 

Conflict Health Check 

The Conflict Health Check is a professional service delivered within an agreed timeframe following payment and confirmation of the booking. 

Where work has commenced, including preparation, review of information or delivery of the Health Check, refunds will not normally be available. 

Where cancellation is requested before work has started, the Provider may consider a refund, less any reasonable costs or preparation already incurred. 

Where appropriate, alternative arrangements may be discussed depending on the stage of delivery and work already completed. 

 

15. Refund Processing 

Approved refunds will be processed using the original payment method. 

Refunds are processed on the last Friday of each month. 

Please allow up to five working days after processing for funds to appear in your account. Processing times may vary depending on your bank or payment provider. 

16. Rescheduling 

Requests to reschedule will be considered subject to availability. 

Where significant preparation, planning or costs have already been undertaken, the Provider reserves the right to review arrangements before confirming a new delivery date. 

17. Intellectual Property 

All materials, resources, frameworks and presentations provided by the Provider remain the intellectual property of Aspects Mediation Services Ltd  unless otherwise agreed. 

Materials must not be copied, reproduced, distributed or used commercially without written permission. 

18. Recording 

Audio recording, video recording, photography or screen recording of sessions is not permitted unless agreed in advance in writing. 

19. Limitation of Liability 

The Provider accepts no responsibility for decisions, actions or outcomes arising from the application of learning or guidance provided through the services. 

Nothing in these Terms excludes liability where it cannot legally be excluded. 

20. Governing Law 

These Terms and Conditions are governed by the laws of England and Wales.
